Background The present case was initiated by two Dunlop tires distributors which complained about alleged anti-competitive sporting regulations on the part of a Belgian sporting organisation in the field of kart racing. The “Association Sportive Automobile Francophone” (“ASAF”) is a non-profit organization whose object is to promote, coordinate and regulate motor sport. Among other activities, ASAF is in charge of the organization and running of motor sport events. It has exclusive powers to design and implement motor sport regulations applicable within the French- and German-speaking provinces of Belgium.
