The Polish NCA restates that professional bodies must comply with competition law provisions notwithstanding the existence of potential alternative legal basis (Poznan Chemists’ Chamber)

The decision at hand, rendered on December 15, 2005 recalls previous decisions issued by the President of the Office of Competition and Consumer Protection (hereafter “OCCP President”) (See J. Faruga and V. Metonidze, The Polish Competition Court upholds the decision of the competition authority declaring the Notarial Chamber liable for concluding an anticompetitive agreement, e-Competitions, May 2005, n° 36) which shows that the question of respecting competition law provisions by professional bodies is a recurrent subject in Poland. In June 2005, the District Chemists' Chamber of the Greater Poland Voivodship in Poznan (hereafter the “Chemists' Chamber”) issued a resolution concerning “the unlawful publicity of drugs” by which imposed on the head of a pharmacy to refrain themselves from
