The UK Competition Commission investigates the acquisition of Irish low cost airline’s minority stake in former Irish flag carrier (Ryanair / Aer Lingus)

The acquisition of Ryanair's minority stake in Aer Lingus is currently under investigation by the Competition Commission (CC) under the merger control regime of the Enterprise Act 2002, despite a series of jurisdictional challenges and a potentially conflicting transaction (a renewed bid by Ryanair to acquire the whole of Aer Lingus, which is subject to EU approval). As a result two parallel investigations are running their course, the CC’s investigation under UK merger control on the existing minority shareholding that Ryanair has in Aer Lingus and the European Commission’s investigation of Ryanair‘s latest bid for the remainder of Aer Lingus' share capital, which was announced on 19 June 2012, under the EUMR.
