The Veterinarians' Association (“VA”) is a professional order which represents all the veterinarians established in Belgium. Its primary task is to establish a code of conduct (“the code of conduct”) which regulates various aspects of the veterinarian profession in Belgium. It also holds disciplinary jurisdiction over its members. 1. Facts Until 1998, the VA has addressed to its members a booklet containing minimum tariffs. Infringements to this scheme typically triggered the initiation of disciplinary proceedings against veterinaries providing services in exchange of fees lower than the minimum tariff. Whilst the VA officially abandoned the publication of minimum tariffs in 1998, it nonetheless sought to impose to its members the observance of “generally applied tariffs” until 2001.
