The Portuguese Competition Authority deems illegal an agreement concerning the distribution of pay-TV channels (SIC and TV)

Sociedade Independiente de Comunicação (hereinafter “SIC”) is the leading private free-to-air broadcaster in Portugal. Upon the advent of pay-TV in the country, the undertaking set up a series of theme channels, including SIC Notícias (a news channel), SIC Radical, SIC Comédia and SIC Mulher. All of these channels are marketed as part of the basic pay-TV package (i.e. none of them are premium channels). PT Multimédia is a subsidiary of Grupo Portugal Telecom, Portugal's incumbent in the telecommunications sector. PT Multimédia is active, inter alia, in the provision of pay-TV services via cable. The subsidiary of PT Multimédia in the pay-TV sector is TV Cabo Portugal (“TV Cabo”). The three undertakings (SIC, PT Multimédia and TV Cabo) concluded in March 2000 a cooperation agreement
