The Cyprus Competition Authority rejects a complaint from a company operating in the distribution and sale of dairy products concerning alleged abuse of dominance and economic dependence (Palmerco / Detelina)

Introduction On 16 April 2019 the Cyprus Commission for the Protection of Competition (“CPC”) rejected, by majority, a complaint filed by Palmerco Ltd (“Complainant”) on 17 February 2015. The complaint concerned an abuse of a dominant position by Detelina Dairy Ltd (“Respondent”) as well as an abuse of the economic dependence relationship in violation of the Protection of Competition Law (Law 13(I)/2008), as amended (“Law”). Undertakings concerned The Complainant operates in the distribution, placement, sale and promotion for sale of the dairy products produced by the Respondent, such as Kefir, Kefir Light, Strawberry Kefir, Peach Kefir, Smetana, Riajenka and Tvorog.
