Facts Various Hungarian supermarkets and agricultural organisations, under the auspices of the Hungarian Ministry for Rural Development, fixed the prices of watermelons and agreed not to market imported watermelons. Procedural history After the institution of the competition proceeding, the Hungarian parliament amended Act CXXVIII of 2012 on inter-branch organisations and on certain issues of the regulation of agricultural markets, which entered into force with immediate effect, i.e.also as to pending proceedings. The amendment establishes, as to the agricultural sector, an exception to the Hungarian Competition Act’s (HCA) general prohibition on restritive agreements.
