The French Competition Authority publishes new fining notice

On 17 May 2011, the French Competition Authority published the final version of its new notice on the method of setting fines for competition law infringements (the "Fining Notice"). This document aims to enhance transparency on the method followed by the French Competition Authority when setting fines: the Authority will provide upfront guidance to the parties when arguing their case, before the French Competition Authority adopts its decision. The publication of the Fining Notice follows a public consultation launched by the French Competition Authority on a draft notice earlier this year.
