On 21 April 2010, the Commission adopted final versions of the new Vertical Agreements Block Exemption Regulation (“VABER”) and Vertical Restraints Guidelines (“Guidelines”). The new VABER will enter into force on 1 June 2010, and will expire at the end of May 2022. The new VABER provides for a transitional period of one year (until 31 May 2011) for agreements already in force on 31 May 2010 which satisfy the conditions of the current VABER (Regulation n° 2790/1999 EC [1]) but not the new VABER. In general, it would appear that the new VABER and Guidelines are unlikely to have a significant effect on existing agreements, as they continue to reflect the same Commission policies.
