White Paper on damages actions for breach of EC antitrust rules. What Does It Mean For Business? The White Paper brushes aside fears expressed in the business world and among practitioners about the import into Europe of a US-style mixture of aggressive class actions and treble damages and adamantly stresses that a “genuinely European approach” will be adopted. It rejects the introduction of US features such as punitive damages, opt-out class actions, contingency fees, or the “no contribution rule”, according to which a defendant who has compensated the plaintiff for all of his or her damage as a result of joint and several liability cannot seek indemnity
