Introduction On 2 April 2008, the European Commission adopted a White Paper on damages actions for breach of the EC antitrust rules (hereinafter ‘the White Paper’) [1]. It presents a set of recommendations to ensure that victims of competition law infringements have access to genuinely effective mechanisms for obtaining full compensation for the harm they have suffered. The White Paper is the latest stage of a policy initiative, the premises of which were already laid down in Regulation 1/2003 [2] that stressed the essential role of national courts in the application of the EC competition rules, for example by awarding damages to the victims of infringements [3].
