The Belgian Competition Council conditionally clears a merger in phase II between several owners of cable networks for telecommunications services in Wallonia (Tecteo/Brutele - Câble Wallon)

The operation Following a Phase II review, by decision dated 25 April 2008 the Council authorized the two-stage merger resulting in the acquisition of control by Tecteo of certain cable networks in Wallonia. The concentration involved several associations of local authorities transferring their respective telecommunication cable networks to Tecteo in a first phase. In the second and final phase of the transaction, Brutele merged with and into Tecteo with Tecteo remaining as the surviving undertaking. The market(s) The market for cable networks for standard analogue or digital TV channels. Remedy 1: Commitment to refrain from imposing exclusivity obligations on owners of standard TV channels (i.e., not pay TV channels) The Council found that as an owner of an essential facility,
