The Mannheim Regional Court and the Dortmund Regional Court decide on damages claims brought by the vitamins cartel’s customers (Vitaminpreise)

Following the European Commission's decision regarding the vitamin cartel (Commission Decision 2003/2/EC, of 21 November 2001, relating to a proceeding pursuant to Article 81 of the EC Treaty and Article 53 of the EEA Agreement (Case COMP/E-1/37.512 - Vitamins), OJEC L 6, 10 January 2003, pp. 1-89), several claims for compensation have been brought before the German courts of first instance by customers of the cartel members. The first judgments to deal with these claims have generally dismissed the actions (cf. notably the judgment of the Regional Court of Mainz of 15 January 2004 and of the Regional Court of Mannheim of 11 July 2003, upheld by the Higher Regional Court of
