The European Court of Justice reviews the Antitrust agreement signed between the Commission and the United States and holds that the Commission acted outside its competence to conclude such an agreement

"Case 327/91 Judgement of the Court 9 August 1994 Agreement between the Commission and the United States regarding the application of their competition laws"* Pursuant to an action brought by the French Republic on 16 December 1991 under the first paragraph of Article 173 of the EEC Treaty and Article 33 of the ECSC Treaty for a declaration that the Antitrust Agreement signed on the 23 September 1991 by the Commission of the European Communities and the Government of the United States regarding the application of their competition laws is void, the Court of Justice on 9 August 1994 held that the Commission acted outside its competence to conclude such an agreement and therefore the act concluding the agreement was void.
