La réparation des préjudices causés par les pratiques anticoncurrentielles

Rafael Amaro, Jean-François Laborde

This collection brings together and comments on the French courts’ main rulings on compensation for damage caused by anti-competitive practices (private enforcement). It discusses the main difficulties that judges and parties are likely to face: limitation periods, jurisdiction, evidence, establishing the conditions for the civil liability of the perpetrators of anti-competitive practices, and assessing the damage caused by these practices (cartels and abuse of dominant position). Thus, the collaboration of an academic and an economic expert makes it possible to answer the essential question of private enforcement: how and how much?
