Written by a practitioner, member of a Greek law-firm, this book is exploring the concept of “market separation,” i.e. conduct that may hinder cross-border trade. To that purpose, the author, focusing notably on the treatment of geographic price discrimination and exclusionary abuse, by which out-of-state competitors are affected, adopts an interesting comparative analysis between Article 102 of the Treaty on the functioning of the European Union (prohibiting abuse of dominant position) and free movement rules established by the same Treaty. Special attention may be paid to the chapters dealing with what the author calls the “shared responsibility for market separation by dominant undertakings and the state,” advocating for a revised state action defence.
