Finanzlandesdirektion für Tirol a. o., case C-368/04 Par son arrêt TAL du 5 octobre 2006, la Cour est conduite à confirmer deux jurisprudences bien établies. L'arrêt ne manque pourtant pas d'intérêt dans la façon de construire les réponses apportées à la juridiction nationale autrichienne. Malgré les termes clairs et sans équivoque des arrêts de la Cour du 21 novembre 1991 (Fédération nationale du commerce extérieur des produits alimentaires, affaire dite “des saumons” : aff. C-354/90, Rec. p. I-5505) et du 21 octobre 2003 (Belgische Staat c/ Eugène van Calster et Felix Cleeren, aff. jtes C-261/01 et C-262/01, Rec. p.
