Current developments in European and French antitrust investigations (January – June 2018)

This article provides an update on the rules applying to antitrust investigations carried out by DGCOMP and the French competition authorities. The new rules, case law and agency initiatives in that field over the past six months are covered. At the EU level, the Alcogroup judgment of the General Court is definitely worth noting, not that much on the reasoning followed but rather because it reveals again the legal privilege difficulties systematically faced by companies targeted by successive dawn raids. The General Court also annulled part of the scope of an inspection decision in the České dráhy case, failing sufficient grounds to suspect an infringement. At the French level, a number of decisions of interest have been delivered in the 3G mobile investigation (Free, Iliad), in the egg investigation (CDPO, Matines), and concerning an inspection run by the European Commission (Casino, INCAA), which is rather unusual.
