Le 16 mai 2018, le Tribunal de l’Union européenne (le « Tribunal ») a partiellement annulé la décision de la Commission européenne du 25 juillet 2016 par laquelle celle-ci a rejeté la demande de la compagnie aérienne allemande Deutsche Lufthansa AG (ci-après, « Lufthansa ») d’être exemptée des engagements tarifaires auxquels elle est soumise concernant ses lignes Zurich – Stockholm (« ZRH-STO ») et Zurich – Varsovie (« ZRH-WAW »). Ces engagements sont inclus dans la décision du 4 juillet 2005 approuvant de manière conditionnelle l’acquisition de Swiss International Air Lines Ltd (ci-après, « Swiss ») par Lufthansa, cofondateur et membre de la plus vaste association de compagnies aérienne au monde, Star Alliance.
