Brazil : Competition policy five years later - Still in search of better practices ?

Cet article propose l’adoption d’une méthode de "meilleures pratiques" pour l’évaluation des politiques publiques et des institutions, ayant pour focus l’implementation d’une politique de la concurrence. Après l’identification des variables centrales dans ce but, on envisage le cas brésilien. Le Brésil a adopté une méthode d’élaboration des meilleures pratiques pendant l’implementation de la nouvelle loi de concurrence, ce qui a permis le CADE d’être vu comme une autorité majeure. Toutefois, la recherche des meilleures pratiques est un long chemin et ainsi, à la fin de l’article, on essaie d’indiquer quelques des défis émergents.

I. Introduction 1. There are two ways in which one can look at institutions or policies within a country : (i) by assessing how they deviate from the so-called “best practices,” that distinguish countries with different patterns of development ; or (ii) by examining how they have resulted from historical choices made for a particular type of society. [1] 2. I believe this second path to be more appropriate in order to discuss the restructuring of public policies. It provides a more consistent and elaborate toolbox for the understanding of policies, as well as for their design, for the diagnosis of challenges, and for strategies for their implementation. 3.
