Depuis l’adoption des premières règles de concurrence il y a huit ans, le régime chinois de la concurrence s’est considérablement développé. L’une des avancées majeures est d’avoir fait prendre conscience de l’existence de ces règles auprès des consommateurs et des entreprises en Chine. Alors qu’une plus grande expertise ainsi qu’une meilleure expérience casuistique sont encore à développer, l’analyse économique devrait également prendre une place plus importante dans la mise en œuvre des règles de concurrence, notamment en matière d’enquêtes. La Chine prend également beaucoup de précautions pour développer ses lignes directrices sur les règles de concurrence applicables en matière de propriété intellectuelle et fournira une version mise à jour et consolidée afin de recueillir des commentaires du public.

China’s Anti-Monopoly Law (AML) has been enacted for eight years now. Could you give us an overview of the enforcement activities thus far ? The Chinese antitrust regime is young compared to those in many other countries. In these short eight years, China has made tremendous progress in a number of aspects : in terms of legislation, there have been a large number of new regulations and guidelines issued from AML enforcement agencies. These documents cover procedural and substantive issues that help practitioners and businesses to understand and comply with the AML. In terms of enforcement activities, MOFCOM’s merger reviews have been steadily increasing over time. It reviewed over 400 applications in 2015, and its announcements on case decisions have offered more and more details about
