CAA Marseille, 7 novembre 2011, Corsica Ferries, n° 08MA01604 La société Corsica Ferries, concurrente de la SNCM et de la CNM pour le transport de passagers entre la Corse et le continent, a demandé au juge administratif d’annuler la convention de délégation de service public maritime dont la SNCM et la CNM ont été chargées par la Région de Corse au motif notamment que la convention contenait une clause de sauvegarde constitutive, sur la base de la jurisprudence Altmark, d’une aide d’État qui aurait dû être notifiée avant d’être mise à exécution à la Commission européenne.
