The Macedonian Supreme Court upholds the Competition Authority’s decision prosecuting a mobile phone operator for abusive voicemail charges (Cosmofon)

On 13 September 2010 the Macedonian Supreme Court [1] upheld the infringement decision issued by the Macedonian Competition Authority (KZK) [2] against the mobile phone operator Cosmofon [3] for committing an abuse of dominant position on the market for mobile phone call termination on its own network. The first infringement decision [4] against Cosmofon was issued by the KZK in 2008. The KZK qualified as an abuse of dominance the fact that the consumers calling Cosmofon's clients were charged not from the moment when they started to narrate the voicemail message but from the moment when the voicemail service was reached.
