The Italian Competition Authority accepts commitments in the mobile telephony market closing its investigation against the three mobile network operators under Art. 81 and 82 EC (Tele2 / Vodafone / TIM / Wind)

The Italian Competition Authority (AGCM) continues to use its new powers to issue commitments decisions. Similarly to article 9 of Council Regulation (EC) n° 1/2003, of 16 December 2002, on the implementation of the rules on competition laid down in Articles 81 and 82 of the Treaty (OJEC L 1, 4 January 2003, pp. 1-25), art. 14 ter of Italian competition law allows a firm subject to an antitrust proceeding to offer commitments. Provided that these commitments meet the preliminary concerns of the Italian competition watch-dog, and are accepted, the proceedings is closed without any infringement decision. On 24 May 2007, the AGCM accepted and made binding the commitments of Vodafone in the Tele 2 / TIM - Vodafone - Wind case. This proceeding dates back to February 2005, when the AGCM
