The Serbian Competition Authority modifies its leniency decision in a case of a vertical distribution agreement with a resale price maintenance clause (Idea, Swisslion Group)

On 25 October 2012 the Serbian Competition Authority (KZK) [1] established that by including the resale price maintenance clause (minimum resale prices) in their distribution agreement Idea d.o.o. (distributor) and Swisslion Group d.o.o. (supplier) have concluded an anti-competitive agreement contrary to the national equivalent of Article 101 TFEU. As a result of the application of the leniency provisions the KZK has approved the immunity from fines for both parties who have both notified their agreement to the KZK prior to the commencement of the investigation. The case dates back to 2009 when Swisslion on 26 October 2009 and Idea on 30 October 2009
