The Croatian Administrative Court upholds the decision of the NCA imposing interim measures following an assessment of the unilateral termination of the motor vehicle distribution agreement (Tomić)

On 27 January 2010 the Croatian Administrative Court [1] upheld the decision [2] of the Croatian Competition Authority (AZTN) [3] imposing interim measures in the case of unilateral termination of the agreement on selective distribution of BMW automobiles. The applicant, Tomić & Co. d.o.o. (Tomic) was an exclusive supplier of BMW automobiles in Croatia, which moved to terminate its distribution and repair services agreement with Šimatić d.o.o. (Simatic). Tomic explained that it terminated the distribution and repair services agreement with Simatic because the latter in violation of the agreement sold four automobiles to third parties that have further resold them to final consumers.
