The Japan Fair Trade Commission issues cease and desist orders and imposes surcharges on air freight forwarders for having implemented a price-fixing agreement (Nippon Express)

Cease and Desist Order and Surcharge Payment Order Against Air Freight Forwarders* The Japan Fair Trade Commission (hereinafter referred to as “JFTC”) had investigated companies engaged in international air freight forwarding business [1], under the provisions of the Antimonopoly Act (hereinafter referred to as “AMA”) and found that they had been involved in activities in violation of Article 3 (prohibition of unreasonable restraint of trade) of the AMA. Accordingly, the JFTC today issued against them a cease and desist order pursuant to the provision of Paragraph 2, Article 7 of the AMA and surcharge payment orders pursuant to the provision of Paragraph 1, Article 7-2 of the AMA, as described in 1 below.
