The Moldovan Competition Authority finds an exploitative abuse of dominant position in the invoicing practices of an electricity distributor (RED Union Fenosa)

On 22 February 2011 the Moldovan Competition Authority (ANPC) [1] established that I.C.S. RED Union Fenosa S.A. (Union Fenosa) has abused its dominant position on the market for supply and distribution of electricity at regulated tariffs by including an automatic notice of disconnection in its monthly invoices. The dominance of Union Fenosa on the relevant market was established by the ANPC in 2008 [2] after the three electricity distributors controlled by the Union Fenosa Internacional S.A. (I.C.S. RE Chisinau S.A., I.C.S. RED Centru S.A. and I.C.S. RED Sud S.A.) merged into one company – I.C.S. RED Union Fenosa S.A. The Law on Protection of Competition
