The Hungarian Competition Office refuses to use public resources for investigating an allegation of excessive pricing in the electricity sector (Budapesti Elektromos Mûvek Nyrt)

Background In its decision of 10 March 2008 (HCO Decision), the Competition Council of the Hungarian Competition Office (HCO) terminated the proceedings against Budapesti Elektromos Mûvek Nyrt (Elmû). Elmû is the electricity distribution system operator company in the metropolitan area of Budapest. The scope of the investigation preceding the HCO Decision dealt with the allegedly abusive price increases of Elmû with respect to replacement services of one-way and three-way power switches, between 2002 and 2006. A power switch is a device which is utilized to control the voltage within a household's power circuit. Pursuant to sector specific regulation, power switches are the sole property of the distribution system operator and replacement of such devices may be carried out exclusively
