The Croatian Administrative Court upholds the decision of the NCA finding an abuse of dominance on the market for distribution of cigarettes (Adris grupa, Ronhill)

On 24 March 2010 the Croatian Administrative Court [1] upheld the decision [2] of the Croatian Competition Authority (AZTN) [3] finding an abuse of dominant position on the market for distribution of cigarettes. The applicants in this case, Adris grupa d.d. (former tobacco factory in Rovinj - Tvornica duhana Rovinj d.d.) and its affiliate Ronhill d.o.o. (Ronhill) were active on the market for production and distribution of cigarettes. Following the complaint of Ronhill's competitors, BAT Hrvatska d.o.o. and Tvornica duhana Zadar d.d.(tobacco factory in Zadar) the AZTN examined the general terms and conditions applied by Ronhill for marketing of its cigarettes through a network of distributors. In its decision the AZTN established that Ronhill abused its dominant position on the market
