The Moldovan Competition Authority applies the ne bis in idem principle in the investigation of abuse of dominance in the electricity market (Gas Natural Fenosa Furnizare)

On 21 June 2018 the Competition Council of the Republic of Moldova (CC) [1] has concluded its investigation into the alleged abuse of dominant position in the form of refusal to deal on the part of the electricity supplier Gas Natural Fenosa Furnizare Energie SRL. [2] Based on the principle of ne bis in idem, the CC has concluded that there was no need for intervention on its part. The CC’s investigation was prompted by a complaint submitted by S&D Service SRL in October 2017. The complainant has purchased a real estate located in Bucovăţ town of Străşeni county. The sale contract expressly provided that debts for the electricity consumption, delivered to the real estate in question, remains as the seller's debt.
