The Czech Supreme Administrative Court clarifies rules for challenging dawn raids by third parties (COLAS CZ)

On 25 January 2018, the the Supreme Administrative Court (SAC) rejected the cassation appeal lodged by COLAS CZ against the previous Regional Court in Brno (RCB) judgment rejecting COLAS CZ’s claim as being belated. The case concerned a challenge made by a co-cartelist to a dawn raid which had taken place at the premises of a different cartel member. The SAC agreed that the claim was time barred.
