The Supreme Court of Chile condemns abuse of dominant position in the cigarette market (Chiletabacos)

On 4 December 2012, the Supreme Court handed down its judgment in the appeals brought by the National Economic Prosecutor's Office of Chile (Fiscalía Nacional Económica or FNE) and Philip Morris Chile Comercializadora Limitada (Philip Morris) – subsidiary of Philip Morris International -, overruling the Competition Tribunal's (TDLC) decision dated November 2011, and imposing a total fine to Compañía Chilena de Tabacos S.A. (Chiletabacos) -subsidiary of the British American Tobacco Company- of over a million euros for abusing of its dominant position in the national cigarette market. This case has its origin in TDLC's Decision N° 26 of 5 August 2005 (Decision 26/2005), over a claim presented by Philip Morris against Chiletabacos before the same tribunal.
